What You Need To Know About The Two Massive Toyota Recalls

What You Need To Know About The Two Massive Toyota RecallsToyota has issued two massive recalls this year. The first was part of the large Takata airbag recall and the second is for faulty fuel-emission controls. These two issues have lead to the recall of over 4 million Toyota vehicles. So if you drive a Toyota vehicle, here is what you need to know about these two recalls.

Takata Airbag Recall

The Takata airbag recall is the largest automotive recall in history. After the deaths of 11 individuals, 85 million recalls have been issued for vehicles containing Takata airbags. Star Trek Actor’s Death Linked To Jeep Recall

Star Trek Actor’s Death Linked To Jeep RecallOn June 19, 2016, Anton Yelchin, most famously known for playing Pavel Chekov in the rebooted Star Trek films, lost his life in an accident involving his 2015 Jeep Grand Cherokee. Yelchin was killed at his home, after his Jeep Grand Cherokee rolled backwards down his driveway and pinned him against a brick wall and a fence. This freak accident is still under investigation, but may be linked to a April 27, 2016 recall of the vehicle.

The Fiat-Chrysler Gear Shift Recall

On April 27, 2016, Fiat-Chrysler, manufacturers of the 2015 Jeep Grand Cherokee involved in the Yelchin fatality, recalled 1.1 million vehicles for having a confusing gear shift, leading to a rollaway risk. This recall was prompted by a National Highway and Traffic Safety Administration investigation that found the gear shift was “unintuitive.” Unlike typical gear shifters, the recalled shifter is moved back and forth to change gears, always returning to the same upright position regardless of gear. Since there is no difference in physical position, many operators did not understand when... ...read full post

Personal Injury Law 101

Personal Injury Law 101Personal injury law encompasses a large spectrum of issues – whether you or your personal property has been injured or damaged in a wrongful manner – also known as ‘tort’ law. Essentially, this is the law that allows you to be compensated if you have been hurt by someone else’s carelessness, recklessness, or intentional misconduct. For example, automobile accidents in which you are the victim would be considered a case for personal injury or tort law, and this law dictates who may be responsible for causing an injury, and hold them liable for damages resulting from their negligence.

What Do I Do If I’ve Been Hurt?

The first thing you need to understand if you think you’ve found yourself the victim of someone’s negligence is to understand what constitutes as a tort offense. The majority of these offenses are caused in motor vehicle accidents, but can also encompass things such as:

Unsafe foods;
Untested products;
Burns;
Assault;
Poisoning;
Animal bites, etc.

If you’ve sustained an injury, illness, or damage done by any of these or like offenses, there are certain things that should and should not be done by you to make a... ...read full post

What To Do If Your Vehicle Has Been Recalled

What To Do If Your Vehicle Has Been Recalled When a vehicle is recalled, this means that either the vehicle manufacturer or the NHTSA has determined that a specific model (or several models within a certain period) either has a safety related defect, or just does not comply with a federal safety standard. The auto manufacturer will alert those who own these models of the issue, and typically offer a free repair.

Keeping in mind that a vehicle recall does not mean the entire vehicle will be replaced, the companies that make them are required by law to send letters to alert their customers who are affected, and if you’re ever curious, you can also find the up-to-date information on recalls on the NHTSA website. The recall letter should contain information such as:

A description of the defect(s);
The hazard or risks posed by the issue;
Potential warning signs of the issue;
How they (the manufacturer) plans to fix the issue, including when repairs are available and how long they will take;
Instructions on what you should do next.

If you receive a recall letter, it’s important you... ...read full post

Premises Liability And WildlifeEvery year, millions visit Florida to enjoy the many attractions, beautiful weather, and great scenery. Catching a glimpse of the wildlife here is also a wonderful experience, but what happens if one of the animals in the region injuries someone while in a public place or on private property?

It’s a question that is often overlooked, though the tragedy that occurred at Disney back in June of 2016 has brought it into the forefront of our minds. While that family has announced that they won’t be seeking compensation, many may find that they are in a situation where seeking compensation for injuries is the only way to get their financial stability back on track. In these cases, animal related injuries fall under premises liability law.

Premises liability in Florida can be difficult to fully understand, and when wildlife is involved it can become even trickier. For these types of cases, it’s important to be able to turn to a skilled personal injury lawyer who can help. However, understanding some basics is still a good idea.

Overcoming The Stigma Of Personal Injury Law

Overcoming The Stigma Of Personal Injury Law For years, personal injury law has gradually gotten a bit of a bad rap. This is largely thanks to the way that some TV shows or films portray personal injury attorneys, not to mention media coverage of frivolous lawsuits. But there is something that the media often doesn’t show to the public – the very real fact that for those who are injured in an accident, seeking financial compensation is often the only way to overcome the challenges they face and get their life back on track.

In short, personal injury lawyers help people, and busting through that negative stigma so many have attached to the field is important. Many actually hesitate to seek assistance when they need it just because of this stigma, and moving forwards past this is something that society as a whole needs to do.

Getting Your Life Back

After an accident, the road to recovery can be incredibly long and difficult. Recovering from physical injuries can take weeks, months, and even years. The mental pain and emotional hardship can be hard to overcome... ...read full post

Understanding Wrongful Death

Understanding Wrongful Death Of all the various types of personal injury law, one of the most damaging to families is that which involves wrongful death. Wrongful death law has a direct impact on everyone in the life of the person who is lost, and in more ways than one.

While overcoming the loss of a loved one is an emotional challenge that will leave lasting memories forever, it’s even worse when the death could have been prevented and was instead caused by the reckless or negligent actions of another. Taking a closer look at wrongful death law is something that is well worth doing for anyone who has lost a loved one recently.

What Is Wrongful Death?

Essentially, wrongful death in terms of Florida law refers to a death that has occurred as the direct result of the reckless or negligent actions of another party. If certain conditions are met, the negligent parties could be ordered to pay financial compensation to the family of the deceased.

In order to seek compensation for wrongful death, it must be proven that the other party acted in a way that was negligent or... ...read full post

Understanding The Jeep Cherokee Transmission Recall

Understanding The Jeep Cherokee Transmission RecallVehicle recalls are becoming a sad fact of daily life in the world of the auto world. It seems like every week there is another recall occurring, some minor and some very major. One of the most recent that has gotten serious attention is the Jeep Cherokee gear shift problem.

This issue was quietly made public in the same way as most auto recalls, with an official announcement and then letters being sent out to all who owned the affected vehicles. But what catapulted it into the spotlight was the death of actor Anton Yelchin, one of the stars of the recently rebooted Star Trek series. His death is believed to be linked directly to this most recent problem, and it is likely that he was about to receive a recall letter regarding the issue.

The Problem

Unlike some other recalls, this one isn’t directly related to a manufacturer’s defect. Instead, the system is working as intended but the problem is that the gear selector is designed in a confusing way – it can cause it to appear as though... ...read full post
